Lufkin Truck Driver Error Lawyer

Are you injured, or have you lost a loved one due to a truck driver error?

Lufkin Accident Attorneys Dedicated to Justice for Families:

It is devastating to watch helplessly as the life you worked so hard to build is ripped away from you, which is often the case for truck accident victims and their families. Truck accidents can result in catastrophic injuries, such as traumatic brain injuries (TBI) and spinal cord injuries, completely changing the lives of victims in the blink of an eye. Truckers have a duty when they are behind the wheel of an 18-wheeler to adhere to strict state and federal regulations governing the trucking industry. Trucking rules and regulations are strict because tractor-trailer rigs are the biggest and deadliest vehicles on the road. Therefore, when truck drivers make a mistake while operating one of these vehicles, those sharing the road often suffer the most.

For years, the truck accident attorneys at Mike Love & Associates, LLC, have been helping 18-wheeler accident victims and their families pick up the pieces after semi-truck crashes. Our firm’s founding partner, Mike Love, used to own a trucking company in Angelina County that specialized in transporting heavy loads. During Mike’s time in the trucking business, he made sure his drivers took the responsibility of handling 18-wheelers very seriously and strictly adhered to the trucking industry rules and regulations.

Mike’s experience in the trucking business gave him insight into how other trucking companies routinely allow their drivers to engage in dangerous practices to turn a profit. This knowledge has served Mike well in his legal practice because he knows where the smoking guns are hidden. Therefore, he can often succeed, whereas other trucking attorneys fail when proving that a trucking company or trucker was at fault for an accident.

Types of truck driver errors:

From making an ill-advised wide right turn to not following hours of service rules, a truck driver’s negligence can lead to a truck accident in several ways, including but not limited to the following:

  • Failing to drive safely in bad weather conditions

  • Speeding

  • Violating 18-wheeler weight limit restrictions

  • Not properly securing loads

  • Distracted driving, such as texting and driving

  • Failing to properly inspect and maintain an 18-wheeler, including checking lights, tires, and brakes

  • Violating log book rules and regulations, such as falsifying hours of service records

  • Driving while intoxicated, including drunk driving and driving under the influence of illegal drugs, prescription drugs, or over-the-counter medications

  • Driving while fatigued

Trucking rules and regulations

In addition to the many trucking rules and regulations already in place, new DOT laws for truck drivers are passed every year. Many of the most common trucking regulations have to do with hours of service rules, including:

  • Truckers are required to take a 30-minute break during the first 8 hours of their shift

  • Truck drivers are limited to 14-hour workdays, and they are only allowed to spend 11 of the 14 hours driving

  • Truckers can only work a maximum of 70 hours a week

  • Truck drivers who work a maximum of 70 hours in a week must be off for 34 consecutive hours, including at least two nights from 1 a.m. – 5 a.m
